INSTITUTIONAL FRAMEWORK FOR STRATEGY IMPLEMENTATION

The Committee will execute its mandate along the identified objectives and strategies. The development of the plan has factored in elements of performance management framework.

STRATEGIC PLAN LEGAL AND IMPLEMENTATION STRUCTURE

The structure takes cognizance of Article 133,10, 47, 232 and the provisionsof Chapter 6 of the Constitution in addition to the Power of Mercy Act, 2011(Cap 94).

The implementation structure of the Committee includes, the Committees policies, operations and management framework, defining reporting channels, authority, transparency and accountability levels that ensure the legal structure, integration of operations and support services for the Committee result in optimal performance and service delivery.

THE COMMITTEE

The Power of Mercy Advisory Committee is a Constitutional body anchored in Article 133 of the Constitution of Kenya, 2010. The Committee members are:- the Hon. Attorney General, the Cabinet Secretary responsible for correctional services and, seven other members who are not State officers or in public service appointed by His Excellency the President to serve for a period of five (5) years on part time basis. The members have proven knowledge and experience in matters relating to the exercise of the Power of Mercy.

THE CHAIRMAN AND VICE-CHAIRPERSON

The Attorney General is the chairperson of the Committee. At the first meeting of the Committee, members elect a Vice Chairperson of the Committee from amongst their number. The Chairman and the Vice Chairperson shall not be of the same gender.

MANDATE

On the petition of any person, the President may exercise a power of mercy in accordance with the advice of the Advisory Committee established under Article 133 of the Constitution by:

  1. granting a free or conditional pardon to a person convicted of an offence;
  2. postponing the carrying out of a punishment, either for a specified or indefinite period;
  3. substituting a less severe form of punishment; or
  4. remitting all or part of a punishment.
